specifying, among other things. rules of concluding sales contracts through the Store, containing the most important information about the Seller, the Store and the rights of the Consumer

The provisions regarding the Preferred Entrepreneur apply to contracts entered into as of January 1, 2021.

§ 1 DEFINITIONS

Working days – days from Monday to Friday except for public holidays.
Consumer – a consumer within the meaning of the Civil Code.
Account – a free-of-charge feature of the Store (service provided electronically), regulated by separate regulations, thanks to which the Buyer can create his individual account in the Store.
Buyer – any entity purchasing from the Store.
Privileged Buyer – Consumer or Privileged Entrepreneur.
Privileged Entrepreneur – an individual who enters into a contract with the Seller that is directly related to his/her business activity, but which does not have a professional character for him/her (the definition is effective for contracts concluded from January 1, 2021).
Collection Point – a point located at ul. Mokotowska 71, lokal 101 00-530 Warszawa; Hotel Radisson Blu ul. Długi Targ 19 80-828 Gdańsk, or Hotel Novotel Kraków City West, ul. Armii Krajowej 11 30-150 Kraków.
Terms and Conditions – these terms and conditions.
Store – the Wrzeciono Czasu online store operated by the Seller at https://wrzecionoczasu.pl.
Goods – watches, watch accessories (in particular straps, watch rolls, watch winders), as well as collectible items (including cameras, works of art, and other products indicated in the Store’s offer).
Seller – Dariusz Kocięcki, entrepreneur running a business under the name Wrzeciono Czasu Dariusz Kocięcki, registered in the Central Register and Information on Business Activity conducted by the Minister responsible for economy and keeping the Central Register and Information on Business Activity, NIP 7741701277, REGON no. 611409160, ul. Szlachecka 110, 09-410 Nowe Gulczewo.
Personal Data – information concerning the Buyer or User, in particular: name and surname, residential address or shipping address, e-mail address, phone number, invoicing data, data regarding orders, service activities, complaints, purchase history, as well as data regarding activity in the Store.
Store Activity – information regarding how the Buyer or User uses the Store, including in particular: registration and login, placing orders, using the Account, order history, service activities, complaints, filling out forms, and contact history with the Seller.

§ 3 TECHNICAL REQUIREMENTS


For the proper functioning of the Store, the following are required:
a device with Internet access,
a web browser supporting JavaScript and cookies.
To place an order in the Store, in addition to the requirements specified above, an active email account is necessary.

§ 4 SHOPPING IN THE STORE


The prices of goods shown in the Store are the total prices for the goods.
The Seller notes that the total order price consists of the price for the goods indicated in the Store and, if applicable in a given case, delivery costs.
The Goods may include watches, watch accessories (e.g., straps, rolls, watch winders) and collectibles (e.g., cameras, artworks).
The goods selected for purchase should be added to the shopping cart in the Store.
Then the Buyer selects from those available in the Store: delivery method and payment method, and provides the data necessary for order fulfillment.
The order is placed when the Buyer confirms its contents and accepts the Terms and Conditions.
Placing an order is the same as concluding a sales contract between the Buyer and the Seller.
The Seller will provide the privileged Buyer with confirmation of the contract conclusion on a durable medium no later than at the time of goods delivery.
The Buyer can register in the Store or make purchases without registration.
Data provided by the Buyer during order placement, as well as data regarding the order fulfillment process, are saved in the Seller’s IT systems and may be linked to the Buyer’s Account if the Buyer has an Account in the Store.

§ 5 PAYMENTS


Payment for placed orders can be made, depending on the Buyer’s choice, by:
regular bank transfer to the Seller’s bank account,
via a payment platform (Tpay, Stripe, Bank Transfer),
cash on delivery, i.e., by card or cash upon delivery of the goods to the Buyer,
by card or cash upon personal collection of the goods.
Available payment cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro.
If advance payment is chosen, payment should be made within 3 business days from placing the order.
In the case of card or bank transfer payments, the order fulfillment time is counted from the date the Seller’s bank account is credited.
The Buyer accepts the use of electronic invoices.

§ 6 ORDER EXECUTION


The Seller is obliged to deliver goods free from defects.
The order fulfillment period is 3 business days.
Goods are delivered to the territory of Poland, all European countries (excluding Switzerland), and selected countries outside Europe.
Delivery methods:
courier company,
personal collection at the Collection Point.

§ 7 RIGHT OF WITHDRAWAL


The Privileged Buyer has the right to withdraw from the contract within 14 days without stating a reason.
The period is counted from the day of taking possession of the Goods.
The return also includes delivery costs (with the exception of additional costs resulting from the delivery method chosen by the Buyer).
In the case of collectible items (e.g., works of art, cameras) that require specialized transport or security, return costs may be higher. Information about costs is available in the Goods description or during order placement.

§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL


The right of withdrawal from the contract does not apply in the case of:
custom-made goods,
perishable goods or goods with a short shelf life,
products delivered in sealed packaging that cannot be returned after opening,
items which, after delivery, become inseparably mixed with other items,
audio/video recordings or computer programs in sealed packaging,
newspapers, periodicals, and magazines (with the exception of subscriptions),
goods whose price or value depends on fluctuations in the financial market – this applies in particular to works of art and collectible items.

§ 9 COMPLAINTS


In case of a defect in the Goods, the Buyer may exercise statutory warranty rights or guarantee (if provided).
The Buyer may demand: price reduction, replacement of the item, removal of the defect, and in the case of a significant defect – withdrawal from the contract.
Complaints should be directed to the Seller’s address (§ 2).
Complaints are processed within 14 days.

§ 10 PERSONAL DATA AND MARKETING CONSENTS


1. The joint controllers of personal data are:
– Dariusz Kocięcki, conducting business under the name Wrzeciono Czasu,
– Montresor sp. z o.o.
2. In particular, personal data such as: name and surname, residential address or shipping address, e-mail address, phone number, invoicing data, data regarding orders, service activities, complaints, purchase history, and data regarding the Buyer’s activity in the Store are processed.
3. Personal data are processed for the purpose of:
a) fulfillment of sales contracts and service activities,
b) managing the Buyer’s Account,
c) contacting the Buyer,
d) handling complaints, returns, and claims,
e) fulfilling legal obligations incumbent on the Seller,
f) conducting internal processes related to store operations and customer service, including using IT systems for customer relationship management (CRM).
4. Personal data and data regarding the Buyer’s activity may be saved and processed in the Seller’s IT systems.
5. Providing personal data is voluntary, but necessary for concluding a contract, fulfilling an order, or managing an Account.
6. The Buyer has the right to access their data, rectify it, delete it, restrict its processing, transfer data, object to processing, and withdraw marketing consent at any time.
7. Detailed rules for processing personal data, including information about the Buyer’s rights and data retention periods, are contained in the Privacy Policy available on the Store’s website.

§ 11 RESERVATIONS


The Buyer is prohibited from providing unlawful content.
Each order constitutes a separate sales contract.
Contracts are concluded in Polish.
Disputes with a Buyer who is not a Privileged Buyer shall be resolved by the court competent for the Seller’s registered office.

    3. The Seller may amend the Regulations for valid reasons, particularly in the event of changes in legal provisions, changes in Account functionality, or security improvements.

    4. The Buyer will be informed about the change in Terms and Conditions at least 7 days before it takes effect.

    5. The Buyer’s failure to object signifies acceptance of the amendments to the Regulations.

    6. Disputes with Buyers who are not privileged Buyers shall be resolved by the court having jurisdiction over the Seller’s registered office.

§ 1 DEFINITIONS

Consumer – a consumer within the meaning of the Civil Code.

Account – a free feature of the Store, constituting an electronically provided service, enabling the Buyer to use additional functionalities of the Store.

Buyer – any entity purchasing from the Store.

Privileged Buyer – Consumer or Privileged Entrepreneur.

Entrepreneur with Consumer Rights – a natural person entering into an agreement with the Seller directly related to their business activity, but not having a professional character for them.

Regulations – these Account Regulations.

Store – Wrzeciono Czasu online store operated by the seller under the address https://wrzecionoczasu.pl.

Goods – watches, watch accessories (in particular straps, watch rolls, watch winders), and collector’s items (cameras, works of art, and other products available in the Store).

Seller – Dariusz Kocięcki, operating a business under the name Wrzeciono Czasu Dariusz Kocięcki, ul. Szlachecka 110, 09-410 Nowe Gulczewo, NIP 7741701277, REGON 611409160.

Personal Data – information concerning the Buyer, in particular: name and surname, email address, phone number, residential address or shipping address, billing details, data regarding orders, service activities, complaints, purchase history, and data regarding activity in the Store.

Store Activity – information regarding the Buyer’s use of the Store and Account, including in particular: registration and login, placing orders, using service activities, data editing, order history, complaints, filling out forms, and contact history with the Seller.

§ 3 TECHNICAL REQUIREMENTS

For the proper functioning of the Account, the following are required:
– an active email account,
– a device with Internet access,
– a web browser supporting JavaScript and cookies.


§ 4 ACCOUNT

  1. Account creation is voluntary and free of charge.

  2. The Account enables, in particular:
    a) viewing order history,
    b) checking the status of orders and service activities,
    c) editing Buyer’s data,
    d) streamlining the purchasing process and contact with the Seller.

  3. To create an Account, the Buyer fills out the registration form available in the Store, providing the data necessary for its creation.

  4. The Account maintenance agreement is concluded for an indefinite period upon Account registration.

  5. Data provided in the Account and data regarding the Buyer’s activity in the Store are recorded and processed in the Seller’s IT systems.

  6. Data regarding orders, service activities, complaints, and purchase history may be linked to the Buyer’s Account to ensure comprehensive service.

  7. The Buyer may cancel the Account at any time by sending a relevant statement to the Seller’s email address.

  8. Account deletion does not automatically result in the deletion of data whose further processing is necessary for the fulfillment of legal obligations, accounting settlements, handling complaints, or claims.


§ 5 COMPLAINTS

  1. Complaints regarding the functioning of the Account should be submitted to the email address: wrzeciono_czasu@wp.pl.

  2. Complaints are processed within 14 days from the date of their receipt.

  3. The Consumer has the option to use out-of-court dispute resolution methods, in particular mediation, the assistance of a consumer ombudsman, or the ODR platform.


§ 6 PERSONAL DATA

  1. The Seller is the administrator of personal data.

  2. Personal data processed include, in particular: name and surname, email address, phone number, address, billing details, data regarding orders, service activities, complaints, and data regarding the Buyer’s activity in the Store.

  3. Personal data are processed for the purpose of:
    a) maintaining the Account,
    b) fulfilling sales agreements and service activities,
    c) contacting the Buyer,
    d) handling complaints and claims,
    e) fulfilling the Seller’s legal obligations,
    f) conducting internal customer service processes, including using IT systems for customer relationship management (CRM).

  4. Detailed information regarding the processing of personal data, including the Buyer’s rights and data retention periods, is contained in the Privacy Policy available on the Store’s website.
